Overview

Estate Planning is the process of planning for incapacity and death across all aspects of family life and assets.

Generally, Estate Planning involves the preparation of:

  • three powers of attorney (medical, personal, financial)

  • a Will

  • a letter of wishes (setting out how the overall estate plan is intended to operate)

  • superannuation nominations

  • trust succession documentation (for family, discretionary or hybrid trusts)

and review of any other paperwork such as unit trust deeds, agreements (business, succession, loan, shareholders, inter-family, management, etc.), constitutions, etc.

It also often involves advice about foreign assets or foreign Wills.

Estate planning is very personal and specific to the client’s unique circumstances.

  • Step 1

    We have our initial contact and set up a meeting.

    Step 2

    We meet you to take instructions and discuss your circumstances and what documents you would like us to prepare.

    Step 3

    We prepare draft estate planning documents.

    Step 4

    We provide you with your draft documents for your review.

    Step 5

    You review your draft estate planning documents and provide us with any feedback, further information or ask questions you may have.

    Step 6

    We finalise your documents for signing, then print and bind your documents in preparation for the signing meeting.

    Step 7

    You attend our office for the signing meeting, we walk you through the final versions of your documents, execute the documents and provide you with the original powers of attorney to be signed by your attorneys.

    Step 8

    We receive the executed and completed powers of attorney documents from you and check they have been executed properly.

    Step 9

    We hold the originals at our office and provide you with our final letter of advice and either a USB with digital copies of your documents for you to print, store on your computer or distribute to family (if you wish). Alternatively, we can provide you with a bound booklet with copies of your original documents and legal information about each document.
